The only requirement is that the new job description should be same or similar (match 50%) as the job in the underlying LC.

Use I-134 instead which is used for EB petitions.

If you didnt initially use your EAD to work, you should be fine because you have a valid H1B! See my other thread on this matter please.

Suppose I am employed in H-1b with employer �X� for position �A�. Employer �X� filed my Labor Certification and I-140 for a future position �B� and got both approved. Position �A� and position �B� have at least 50% different job duties.
I file my I-485 and it is pending for more than 180 days. I get a better offer from employer �Y�. Now, I want to transfer my H1-B to employer �Y� using AC21 portability rule. My job description with employer �Y� should be similar to position �A� or position �B�?

Hi Folks
My Labor was approved under EB2 as the job required a Master's Degree but the Lawyer by mistake filed my I140 under EB3 and was approved Oct 2006. The mistake was noticed in May 2007 when we were planning to file for I485. The lawyer refiled my I140 under premium processing on may 23 2007. I checked the status on line and the LUD is May 27 saying application was received. The lawyer told me that CIS is waiting for 'original labor notice' from the labor dept.
Its been 2 months now and I am getting worried.
Anyone who has been in similar circumstances or familiar with this situation pl help. :(

Hi! I need a help.. and I mean HELP. Cause my gc is still pending. we (my family & i) are still waiting for it to come and my problem is that I am planning to go back to my country to study college in there.. Classes will start on the first week of June, and i guess that I cannot wait for my green card to come. My questions are:
1. Can I use my H4 visa (that had been issued in US embassy in my country of origin) to leave US?
2. Do I still need to get AP?? Even if I am a dependent of my parent?
3. Incase our (family) GC arrived in our house here in the US, can they just go home in our country of origin with the green card? (my greencard?)
4. Can I use my green card (brought by my parents from US) to enter back to US???

All,
Per Aug 2008 Bulletin, my dates are current.
But My and My spouse's 485 is transferred to NBC sometime back (we never heard anything)
My daughters 485 is still at TSC.
Anyone know, whats gonna happen now?
I get a feeling that, our apps will be laying eggs while dates are current :mad:
