Hello,
Can Team-IV go to USCIS as a group to ask them to clear the I140s pending quickly. This way, we can ask CIS to follow the FIFO rule.
If they can clear 100+K I129s in 6 months, Why can't they do the same for I140s??. I think there are about
135K pending I140s in CIS (Source immigration-law.com).
That would equate to 340K I485s pending. Even if I consider 10% as duplicates(No Source, just estimate), we will still get about 300K I1485s in the processing queue. This way, everybody will know which category is backlogged and plan accordingly.
As an Individual, we also will have one of the stage completed and be eligible for longer extension of stay etc.
Any suggestions???

i am in a similar situation. i consulted a lawyer who said that even 1 day spent out the country can & must be taken in to account (for the 365 day eligibility). as long as your PERM LC was filed, you should not have a problem.

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.
Will be a problem if they notice, hopefully they will overlook this. As per the Law you have to be on the payroll at all times unless the company has granted you unpaid leave for a very valid reason such as medical emergency etc.

Your MAVNI adjustment of status should cover your family, so they should be adjusting with you. You do not need to or have to send them to your home country.

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . What docs are required for re-entry of spouse on H4 visa. The primary applicant on H1 is not travelling.
1. Copy of I-797 of H1 visa holder.
2. Passport copy of H1 visa holder.
3. Recent pay stubs of H1 visa holder.
3. Marriage Certificate.
Am I missing something.

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2011. USCIS is notifying the public that yesterday, Jan. 26, 2011, is the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY2011.
The final receipt date is the date on which USCIS determines that it has received enough cap- subject petitions to reach the limit of 65,000. Properly filed cases will be considered received on the date that USCIS physically receives the petition; not the date that the petition was postmarked. USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2011 that arrive after Jan. 26, 2011.
USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on Jan. 26, 2011. USCIS will use this process to select petitions needed to meet the cap. USCIS will reject all remaining cap-subject petitions not randomly selected and will return the accompanying fee.
