Dear All,
The idea behind this thread was to consider the option of a Time Bound Path for he beneift of the existing EB2 / EB3 folks who have filed Labour / I - 140 / 485.
I think the purpose of this thread is totally lost.
I am not sure how STEM or F1 or whatever should be a discussion here.
Anything we start here ends up in an acrimonious debate and many a time becomes very unpleasant and personal.
What are we all here for? Is it not our idea to to bring some relief to the EB immigrants?
Once again I request one and all to kindly refrain from unpleasant debates and think of working together for the welfare of the EB2 / EB3 community.
If we have our objectives clear and work towards a common goal, we sure can achieve success!

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?
No matter what whether your case is complicated or not, it is always better to go with an attorney. My brother did that back in 2002 to represent him, but for the attorney his case would have been rejected even though his case was pretty straight forward.

Looks like you guys have decided to fight with Admin2.
To some extent, Admin2 deserves this punishment. He spent just little 60,000 US dollars to fight for all of us. Yes, it is Sixty Thousand dollars. Whenever he goes to DC to meet lawmakers and/or Lobbyists, he spends money from his own pocket for stay and car rental. He deserves so much beating from us for spending so much time, money and enegry for the community.
Even Pappu should be punished for spending too much time on this site wihtout concentrating on his day job.
If you both are logging from SAME company, though you are using different laptop/desktop, the IP address polled will be same for external though you have different IP internally.
If you guys have worked on DC rally, you would have come to know the great spirits of Admin2. One day he called me at 10.30 PM when I was almost sleeping to request me if I can attend an immigration meeting in Princeton University, NJ. I was sleeping and he was making calls. Who would have been benefitted? YOU and ME and NOT Admin2.
There are already several threads with EB3/EB2 fighting. All of us have our own day time jobs. Let us not focus on fighting among ourselves. Let us not even fight with USCIS. What we want is that lawmakers and USCIS should understand our problems and make them realize that US will benefit by giving us GC's and not vice versa.
In the past 2 years, I have just 50 postings. All of them are either confirming calls to law makers or contributions. This I am writing to plead you stop these fightings. We have had enough in the past 2 years.

This does not mean we will not be seeing any approvals now. USICS might have assigned the visa numbers to lot of pending EB2 I-485 applications. They will be adjudicating those cases in few days. So folks keep the faith , keep bugging USCIS (call them day and night) and check immigrationvoice.org every 2 minutes and also don't forget to check your emails and uscis.gov website for CRIS updates every minute :eek:

My lawyer applied for my visa an 23rd Apr under the masters cap. I haven't received The receipt yet. I am wondering if there is anyone on the similar lines. Please reply or is it only me with one such case. I know USCIS has said that they need till 2nd June to resolve the situation. My case is with the vermont center.
I also have my OPT case pending there. It was filed in the first week of May. I have been told that it takes around 90 days for it but sometimes it also takes place early. Please advise.

Please try to read law carefully. The law will not have simple terms as you think. They have to draft the law in the language of the act. Any way the meaning is same.
The law explicitly say that the 7% country limit does not apply to the EB1, EB2, EB3, EB4, EB5 catagories, if excess visas available in those catagories.

Potatoes, maybe.
But seriously growing your own vegetables is a fun activity. I have not done groceries in the last few months (exceptions being junk fast food, yoghurt etc). We grow vegetables all year round. In fact we have excess of most vegetables we grow. Try it, its a lot of fun!
And good luck to all EB2 and EB3 folks - we've seen good EB2 movement and we hope we'll see more movements in both EB2 and EB3 in the days to come. Till then, Happy gardening!!

Probably, she will be deported back to india and ban to USA. But, it may lead to put into you troubles for hiring illegal immigrant, for paying cash and not reporting to IRS. They may even review your tax returns for the past 3 years.

Even I was wondering same thing- Notice Date or Received Date. USCIS website says Received date is taken into account while looking at service centers processing times.
Here is exact line-
"IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance."
Of course, I personally wish that Notice Date takes precedence as it is not our fault that one file just kept on sitting and in saga of moving dates and PD, each day makes a difference.

It is not the date case was received by a center. In the above case, files were just waiting somewhere between Aug 17 and Oct 16. Texas center perhaps opened the case on Oct 16, entered it in the system and sent out a notice. Online status perhaps shows "...your case was received on Oct 16...". So, as far as Texas center is concerned they received the case on Oct. 16.
Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass. Of course, Aug 17 '07 to Oct 16, '07, was not dwhuser's fault, but it put him/her behind a lot of cases whose files were accepted/opened by a center in the meantime.
