That validates my reply previously to a posting by a guy who said that he had called up TSC and they said they go by RD...I had asked him to call back after a day and he'd get totally opposite info.
My situation is the same.....I was TSC-CSC-TSC....but I had received an RFE last year.....dunno why will they preadjudicate and then go by ND which is totally non-sense...logic should be that if a case is preadjudicated it should be put on based on PD..
Again USCIS don't follow any logic...
As I said b4 very few transfer cases will ever get approved.....just bid your time...or apply thru EB1 chances are better that way..

Jay,
You never cease to amaze me, impress me, and educate me.
You have taught me that this goes beyond just getting our green cards.
This is the difference between people that succeed in life and people that don't, people that bring change to the world and people that sit around hoping the world will change for them.
In you, and many others on IV, I see that kind of drive and motivation, and I hope to absorb some of that positive energy.
At times I have wondered why I do this, when most people that I know, who are in a similar situation don't. But I have always come out of that thought process with nothing but reaffirmation of my actions, and the intent to continue doing what I do, thanks to IV members like yourself.
I might get my green card in another year or so, but seeing the unwavering motivation and passion with which some people continue to challenge and change things that aren't right, makes me want to continue doing whatever little or large I can, to help them (and help myself in the process!).

All I want is for you to recognize, that what your argument may lead to, is that the F1 may be altered to be dual-intent, rather than invalidating the F1 to GC path. It is just a matter of perspective. You must be able to see the matter from other points of view

I am EB3-I (pd 02 retrogressed) but was interested in this discussion so i emailed my lawyer about it. She said, historically the last month of the fiscal year has the most approvals as they try to clear as much as they can. You will see a lot more approvals from next week or sept 2nd week.
.......assuming there are still remaining visa numbers. It so happened last few of years that USCIS was sitting on their hands until last month. Is it the case this year ?

Yes, but it is not the receipt generation, it is the actual review of the case as per advertised processing dates. if your case is in the Processing Date window (based on your online receive date), then most likely your case is preadjudicated, and now is waiting for the visa in sequence of PD. Best of luck.
Just spoke to an IO from TSC, she said its the Filing date ( receiving date ) is what the processing time is based on

I think it all boils down to this scenerio
you have a seriously injured uninvited person in your front lawn about to die. what are you gonna do ?
Some people would want that 'problem' to go away and some would want to help the person. Our actions make what we are ..
BTW if anyone is interested, child birth generates 9 dols (measure of pain) of pain and at 10 dols a person dies. 9 dols is maximum pain a human being can suffer.

The sheriffs dept took her to the hospital to ensure that in case there is any complication, things could be take care of. Why? Because its the law and the majority in this country respect the law. No one, even illegals, can be denied emergent care. This would not happen if she were in Mexico or India. No free medical care there, and no one gives a shit about the rights of prisoners there. So what happens next? This woman, WHO HAS NO BUSINESS BEING IN THIS COUNTRY, goes to her advocacy group who arrange to have an article in the news that tries to portray this as if the sheriff forced her to deliver in a prison. This is all to garner sympathy for the illegal immigrant. We should know better and see through their guile. The illegal lobby is the main reason why there is no chance for meaningful reform for legal immigrants to be passed. They insist on linking us to them.
If every one decides to choose for themselves which law they will obey and which they will ignore, society can not exist. And as I pointed out in my previous post, this woman has a history of repeated violations of the law and is NOT a victim that this biased article tries to portray her as.
And your theory about child birth leading to near death like pain is absolutely baseless. Pain is a subjective phenomenon and what is expireinced as a 9/10 by some hysterical yuppy, will be a 0 to others. Childbirth is a NATURAL phenomenon. Ask your grandma and she will tell you how every one delivered without epidurals and caeserians at her time.
