Thunderbold, Sorry for your situation. Here is my observation/suggestion.
Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?
Thats absolutely correct.
And we are sending letters to USCIS saying they don't follow AC-21 rules (not law) properly !!!

Yes, we all shall see. 10,000, lol. I laugh at your post. A good laugh before going to bed is always good.
Friend - Why don't you wait till 9/18 and have this discussion. Oh, hold on, by that time, the rally will be a huge success and you won't be around here to show your face. Strength is in numbers and you will see the power of immigrants on 9/18. If we could reverse a visa bulletin with a rally of 350+ members and couple of hundred flowers, we will be headlines with 10000+ rally. This is going to be a historic event and why don't you take our side and be part of history instead of being an anti-immigrant cry baby.

what should prevail is a matter of perspective. If you are an Indian then skill should prevail, if you are not, then of course it is the other way around

Neverbefore,
I haven't been called for an interview yet, and I hope things remain that way. But I have to thank you for taking the time to share every little detail of your AOS interview. Besides the initiatives that IV undertakes, to me, the next best thing about this forum is enthusiastic members like yourself sharing their stories on AOS interviews, H-1B stamping interviews, RFE/denials/MTR, Infopass, Travelling with AP/Port of Entry and anything else that can be a little nerve racking when you don't know what to expect.
I hope we all do the same for the benefit of this community.

As everyone is aware of the FOIA letters we have received from USCIS. We requested everyone to fax/email us the USCIS letter.
Here is an update on IV plans and what we know till now:
On Friday, during the discussions with USCIS, we came to know that that there is a backlog of FOIA requests and currently they are clearing FOIA requests they received in 2007. We also know from the letter that the report wll not have 'country of chargeability' info. This is a critical info that we ought to have. Even after paying 5K to USCIS, over one year wait time to get the FOIA request completed will be unacceptable to the community.
In light of these developments we have explored other options to get this data and use the copies of replies we get as an example how badly we need this data to get accurate picture of the size and breakdown of the current backlog, so that we can all know how long we need to wait in the current system, if nothing changes. We would also ideally like such data to be always available and updated for public periodically.
Our first option is that we put in effort to get this data without having to pay $5K to USCIS. We will also try to get the data much sooner rather than all of us wait for more than a year. This could be possible via advocacy effort and our initial discussions on this subject have been promising. We will pursue this and if we do not make much progress until the deadline then we may pay 5K and still pursue the advocacy option to get the data faster. Thus we need more than 5K to proceed with these parallel options. The advocacy effort will also be an ongoing task beyond the first month. Thus we request members to sign up for recurring payment option to support this initiative and any other initiative we undertake for the community.
We have added a paypal module on the top of each page with a target amount. Members can use this fresh tool added to IV website to contribute. We prefer if members contributing to the effort on recurring monthly basis for a long term support of IV efforts. All members who contribute through this system will also have access to special 'Contributor's Forum' on the IV website.
Thank You for your effort and contribution for building a stronger community.
Nice to know. Just one question, if we knew this on Friday, why not shared on Friday or over the weekend?

Dear Mr. pascal,
Given that you are the super moderator, how can you even hint that EB3 vs EB2 reflect skill level of employee - don't you know by now that category is determined by "job's Requirement"?!!!!!!
Also your stereotyping of all EB3s as 3 year Indian degree holder is the most unfortunate - I only hope that rest of the IV leadership is not made up of that crappy idea.
For the record, I hold US Master's degree and am really offended by your comment and your view point.
For the rest of the members reading this topic, this is exactly why being EB3 on IV is becoming more frustrating by the day... especially when the super mods posses such views...
I am sorry forthis is wandering away from topic, but everyone including super mod mr. pascal has done that on this thread.

Nss you really have some problem for which you should seek professional help. I am EB2, but I don't go around wining, why I am not EB1, yes the word is winning. I told you yesterday, we didn't make the system and yes I will take the credits for being EB2 because I worked diligently for it, taking student loans and working professional job.
And that job title crap, take it somewhere else, because if that was the case there wouldn't be any Masters or PHD level education, neither there would be STEM. Give credits to our fellow members who come here and work diligently to gain higher education.
And yes, I am sure lot of people will concur with me, the Indian body shop companies, who bring a lot of people from India, abuse the H1b system and file green cards. The EB3 category is a abyss of applications filed for these type of cases.
Next time when you want to argue, keep your facts clear and handy.
Lets drop this topic now, as it serves no purpose. The reason some threads focused on EB2 was because,
1. Number of people stuck in EB2 is higher 2004-2006
2. The back log can be cleared only when, the retrogression can end, I think the cake story didn't make sense to a lot of people.
Lastly please don't post anymore EB2 or EB3, because personally I don't care about that and neither should anyone else. The only way we can bring about this change is through unity and working diligently towards our goals.
All those people who are winning about EB2 or EB2, do some more constructive, how many people did you bring in to IV recently?
How many friends and relatives you called yesterday?
FOCUS
That is how we will will! don't let the divide and rule beat us again, we all read out history books.
My request to administrator is to please bar membership to people who have such bad views, as it will not help to serve our purpose. NSS if you think we are creating a problem for you EB3 and not listening to you guys. You are more than happy to leave and fight your own battle.
It is easier to complain, than to work patiently to bring upon a change. Don't break IV spirit.!

GCStatus,
Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. It is very easy to fire when the gun is on someone else shoulder. We understand and share the frustration with green card delays, but that does not give you license to use derogatory language. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question. Lets talk about passing the baton, how about we start from posting your phone number on the website, lets see how you take that challenge. No one is paid to work on IV. People spend time on this effort out of their good-will and passion for the cause. So please be respectful towards others for their efforts. And please stop being a pain in the neck and talk some sense if you are serious about picking up the baton. Email us your phone number and you will see it on the website within an hour.
Now its time for you to go to all the forums of the world and say that IV Admin is rude and dictatorial or whatever.
All the best,

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??Please respond.
I am sorry...I do not have too much info abt the H4 visas...Actually I am not sure whether she can do an assistantship on H4 only because it is not a visa on which you can get paid any compensation for work...Isnt the institute where she is doing her CPA sponsoring her F1??

1. I am not anti immigration, I am anti illegal immigration. You may not see a difference between the two but I assure you there is one. And no one can make me leave 'in a wink". Why? Because I am not illegal.
2. You are wrong in beliveing that majority of Americans want some amnesty for illegals. They dont, although some policticians have clearly made political calculations and believe that the demography of illegal immigrants will favour them in the polls.
3. You may believe that you are a temporary visitor here. This is home for me.
4. I just side with what I believe is right. That may sound being righteous to you.
5. Your sympathy is misguided again when directed towards condemend criminals. It should be directed towards there victims. I am curious, will you have sympathy for Kasab if he is hanged?
I am certainly not discouraging you in considering this your home but that does not preclude you from seeing the truth.
some politicians? Including the president, right? what does that mean? it clearly means that they are against deporting all those ilegal immigrants who are present here. some sort of amnesty is the only solution accepted by the majority. Now when this will become a law, nobody knows but atleast we have had several weeks of delibrations last year and sooner or later they will get back to it. If it were not for the economic woes and the wars they would be considering the health care and immigration simultaneously.
