Hi ,
One of my friends applied for his GC thru a consulting company which he does not work for...He used to work for the company but left that company before he decided to file with them...Since he has good relations with the company, they decided to file for him.
The company recently filed his I140 but they got a RFE on I140. INS wants to know why does the company want to hire him and why he left the company in the first place..does anyone in the forum has a similar experience to share...The RFE is actually for the conmpany but the owner wants my friend to write a letter and mail it to the lawyer. Any help is appreciated.
First, employer or his agent only reply to RFE, not your friend.
Second, it is a simple stright forward RFE, unless INS found some fishy thing (or doubting as it is a bonafide sponsership) as employee not working for sponser. May be they are trying to control future employee loop hole. Employer can write the reason why he left and why they want to hire him back. It is a strightforward easy question to answer.

1. My colleague crossed 2 years after filing 485. Frustrated with GC processes, he is switching company for better career prospects. He is using his EAD and invoking AC21. Is it possible for me to use his labor? If no, why?

If the W-2 is for more than the LCA requirement, you don't have any thing to worry about.

Immigration law is federal law. You can work with a good attorney anywhere in the country via fax, phone and email.
You are right - based on my personal experience, Like Doctors, it is always good to have an attorney physically reachable; it will be handy when the need arises. I guess, the OP is looking on similar lines.

Just be honest. For now you can say "No" as it is not full time. If VO asks more question on it tell them "you were not sure and ask them what it needs to be since she is doing part time. Take relavent docuemnts to show she is a part time.
All it needs to get visa is Honesty.

My Labor was approved under EB2 as the job required a Master's Degree but the Lawyer by mistake filed my I140 under EB3 and was approved Oct 2006. The mistake was noticed in May 2007 when we were planning to file for I485. The lawyer refiled my I140 under premium processing on may 23 2007. I checked the status on line and the LUD is May 27 saying application was received. The lawyer told me that CIS is waiting for 'original labor notice' from the labor dept.
Its been 2 months now and I am getting worried.
Anyone who has been in similar circumstances or familiar with this situation pl help. :(

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?

You can definetly start any bussiness you want. As per the link below it seems it will be safe to stay with the current employer for atleast 6 months.

One more question...if by chance, God forbid, we dont get our EAD renewal in time, will it impact my studies during the short gap that the new EAD has not come?

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

My company has applied for my H1 extension 3 months in advance of the current expiring H1 under regular processing
1. Does the 240 day rule apply AFTER the expiry of the current H1 OR 240 days from the date you apply for the H extension. I hope its not the latter coz I could have told my employer to apply closer to the expiry instead of 3 months in advance.

My dad's own brother is a U.S citizen. I am here on a H-1B
My dad wants to visit the U.S. Who would be better to sponsor him ?
Me or his brother ?
Also, if his brother sponsors him, would the consulate ask why are you not using your son's papers ?

Is it mandatory to spend [B]at least[B] 6 months residing in the US every calendar year after obtaining a GC? :confused:
If your stay is less than 1 year abroad, you can reenter using just your green card. If you want to stay 1-2 years outside the U.S, you will have to apply for a reentry permit before departure. But, it will be considered as a break (i.e, more than 1 year abroad) in the continous residence requirement of 5 years when it comes to your naturalization application.
If you want to stay longer than that, you will have to apply for "returning resident permit" for which you need to prove that your intent is to be a permanent resident but, your stay abroad longer than the period of the reentry permit was beyond your control.
Please consult an attorney so that you don't lose your PR.

I94: The number should be same for all. You need a copy of most recent one. Although, layers have been taking copies of all I94s. To be on safer side, you can send copies of all I94s.
AP: You can travel on valid AP. Return before it expires.
Renewd AP: It will have new valid dates. When you get this (in USA) then you can use it for travel. I am not sure whether it is OK or not OK to tell friend to mail it in your country of visit and try to come back on this.

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)

this is just me, i would not go anywhere other than fidelity or vanguard..research more in the internet.

They are not liable to pay from the the day application was sent.
Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.
In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).
