I work for a medium sized (employing about 500 employees in USA, another 2000 ouside USA), public (New York Stock Exchange) listed, business technology consulting company, which has been making losses for last 3 years. My I-140 was filed last month. Do I have to start worrying?

Hardwork of immigrants is the bedrock of American society. If seen in that light it makes perfect sense. "We deserve," this thought also ties into the Pygmalion theory. That is the American way. This is not a collective but an individualistic society, unless you showcase your achievments they won't be fully acknowledged. Unless you show that you deserve nobody is going to give it to you.
On another note, I give my example, I changed my job last year and relocated. I don't work for a consultant either. My earlier priority date was Sept. 2002 but I was willing to make a move and not be held hostage to retrogression. I knew it would be tough and many of my friends on H1-B thought it was a bad decision. Atleast, now I won't regret not making a decision. This maybe an isolated example but my old employer hired two American workers to replace me. Maybe its because we work harder or maybe because its both, smarter and harder. As JFK said,"We want to go to the Moon not because it is eazy but because it is hard." We deserve as much as born citizens if not more based on our contribution to this great nation of immigrants.

As a couple of members mentioned that the core will not take any money from the funds members contributed, and its is really unfortunate that Aman + all the core team have to spend a lot of money out of their pocket. I am not a CPA but have seen that a lot of NOP do set aside administrative funds. That how the organization would work. The good ones will have only 10% of funds towards administrative cost. The BEST ONE LIKE IV has NONE (No money for administrative cost!!!). I am sure the core will not want to dive into the funds people are giving BUT can members send money seperately to set up an administrative fund.
I like khodalmd idea, I know not everyone is going to chip in, but if we have atleat 1000 people we can all send $100, so that atleast the core team dont take on the financial burden of the entire community. People sent flowers, a lot of people sent flowers...I am sure atleat 1000 appreciative members can shell out $100 for IV.

Oh yeah .. but that is provided I can file my 485 by that time. Given my PD was just May 06, I had NO preparation for 485 filing, wonder how much time gathering up all the required docs takes for this filing :)
Usually everyone has all the documents. The most common missing document is the birth certificate. It has to be in english if not translation is required. Plus, it should match your name is passport exactly. Otherwise, the american gori is always there as backup :) hehe..:D

I would recommend comprehensive coverage plans for parents. As far as I could tell, there is only one website that sells coverage with pre-existing conditions rider (KV Rao's India Health Network), but that is a limited coverage plan. They have daily limits on most of the hospital charges, but the hospitals usually bill you 3,4 times those daily limits, so you end up paying for the difference out of your pocket. I know this, because I have had first hand experience for my father not too long ago.
So always go for comprehensive plans even though they are more expensive if the parents have any kind of health issues (given their age, who wouldn't !?). Comprehensive plans do not have daily limits - you are only limited by the policy maximum. You are looking at at least 60-80k bill if the patient is in the hospital for 3,4 days; so go for at least 100k coverage.
The way I would look at it is, visitor medical insurance is a lot like auto insurance here. We all pay for auto insurance every few months, and we are very happy if there are no claims against that policy, right? Same thing with visitors insurance too -- buy good coverage, and be happy if you didn't have to use it. That's a small price we have to pay for the pleasure of having our parents around. :-)

IV Core is the best and selfless. They started something, which is going to help everyone in the long run.
I am a memeber of state chapter and very much believe in this concept. Its all about sharing information and thats what the whole idea is about state chapters.
The information flows from top to bottom. There are a lot of things which go in the background which you and me are not aware of, but only the people who are working on it and in our case it is the IV Core. Over the period of time they have encoraged people to come forward and take up the cause. A lot of selfless people have come forward and started helping them out in one way or the other.
What the Core has started is a revolution and it is picking up and a lot more people need to educate themself and join the cause.
If someone does not understand or does not have any motivation, then one can only try to make them understand and motivate and hope for the best.
I dont think IV has ever stopped anyone from saying what they want to, but there is a limit to everything. We are educated immigrants so we all need to act like one. If we dont agree on things we need to come forward and discuss them, instead of starting to criticize.
If you dont share your thoughts then how do you expect people to understand and resolve those issues. So, i will request everyone to come forward with an open mind.

NO point#1 is not true. in fact it is biggest misconception - I remember reading some where that if you have consumed all your 6 years on H1, your extension of H1B beyond 6 years is only based on pending AOS. So in this case, if your 485 is rejected, also your H1B. If you continue to work on H1B even after this, it is illegal.
(This is what I believe & I may be wrong. I am not lawyer, this is not legal advice & check with your attorney first before deciding anything)

The example you state is a violation of anyone's civil rights...leave alone an immigrant.
To use your example, no one is "raping" the applicant by imposing a per-country limit on your green card application and making you wait a few years while you work in the country and enjoy all civil rights.
Congress used the power given to them by the Constitution to frame Immigration laws and they created a formula for regulation. Per-country limit is that formula which they had the constitutional right to create in order to uphold the balance of immigration in their country. Getting a GC is not anyone's right..its a privelege bestowed based on the applicant meeting certain criteria which includes quotas, as per the country's laws. There is NO civil rights impact. You are getting your green card in the end...only problem is they are making you wait 10 years because of that formula. But none of your civil rights are being impinged upon. So we should work to change flawed law and the formula rather than try to muddle the issue with civil rights. No matter what extreme example you give, you will still never be able to prove that your civil rights were impinged because you are having to wait for 10 years in a legal queue while your application is pending.
Don't get caught up trying to defend a stance no matter how irrelevant it may be. Its better we focus our time and effort on more achievable and valid provisions.

H1B visa CAN BE and IS given to teachers. That poster may have had the problem similar to mine and that is having spent 6 yrs in H4, she was ineligible for H1. Let me remind everyone that decoupling of H1/H4 time happened only 2 months ago. Therefore, if the lady in question already possess Bachelor degree (as min requirement for H1) and is otherwise certifiable I dont see a problem for transfer to H1 .
the only problem may be in finding a school district willing to file H1 WELL in advance and accepting the fact that she cannot start working on SEP 1st (when the new school year starts) but OCT 1st.

My analysis if the law is passed in the current form
1. Non displacement provision will delay H1b process. But innovation will not be impacted as best companies Like Google, Microsoft and start up companies will not have a problem in proving that skills are not available in the market.
2. When a company lays off they cannot recruit for 6 months. But a company is laying off people they will hardly recruit for 6 months. Generally when they do less than 5% of staff that will not come under layoff provision and still they can recruit H1b. So only a few positions will be impacted.
3. 50% rule may make many bodyshoppers and Top indian companies force to recruit US Citizens and medium non public companies may split into many companies. Some H1b dependent small and medium companies may go out of business. It will have huge short term impact on H1b aspirants but they will adjust quickly to change their jobs.
4. More powers for DOL will make the companies to follow the law and reduction of abuse
5. Of course the restrictions will make less number of jobs for H1bs and L1s. But when economy improves demand will increase so that H1b cap will be reached inspite of all these restrictions. I strongly believe that system will adjust the new restrictions similar to TARP bill but short term very high impact. But that can be minimised by applying all those restrictions only for new H1bs. Generally more restrictions the persons qualifying will be best and bright and also wages for H1bs,L1s also will increase with improved working conditions.
6. If pro immigrants like IV can negotiate to include Recapture or increase GC cap. But that depends on chance of passing the bill. If IV and other pro immigrants lobby and block the bill then that makes sense. But if the bill gets bi partisan support then it may be wise to take different approach. This bill may be like 2007 and may not be considered at all.

After analyzing this bill, I found the following:
1. This bill will recapture all those unused employment based visas (gcs) from 1997 till 2008 and it will add those recaptured visas to this year's employment based quota.
2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.
3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.
4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.
What makes this bill much more interesting is:
1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.
2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

Just so, everyone understand, I am not trying to find fault with IV or its members. I am trying to do, what you can call, soul searching.
We have around 25000 members. Why only 25000, when we know there are millions out there in the same boat. What is stopping them from joining IV and contributing? Of all these 25000 or so members, we only have around 4000 letters sent for Admin fixes.(May be I am wrong about this number, but I believe it is around that range.) What is preventing the others from doing so?
I strongly believe, that the answers to these questions might help IV in the long run, with more members and possibly more active members. Once we get to that point, IV will no longer be an organization, but it will be a MOVEMENT. Chances of success for a movement is always better than that of an organization. That is what I believe we should try to achieve. I hope everyone agress with that.

In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system?

Yes IV members and other EB folks who are/will benefit(ing) from this are indebted big time to Aman and IV core. Com'on guys this fellow sold his house and spends a good chuck of his time for a selfless cause. IV core can sit on a couch like you and me watch TV, spend time with their family and not bother about contributing a penny. The least we could do is support them.

Where can I find medical insurance for my parents with reasonable coverage with reasonable premium. Their age is between 55 to 60. Obviously they are with some medical conditions like blood pressure, diabetic... like usual stuff like typical parents would have...Can somebody suggest good one... thanks in advance.
