Have decided to dump my H1 for good and start EAD on my new AC21 job soon.
Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

This data is ambiguous from the USCIS. It very well could represent pending 140 petitions, in which case all the euphoria would turn to shock. We must try to get clarification about this before anything else.
One of the tables there mentions the NIW, that is determined at the 140 level, after that a 485 is a 485 and it goes into the EB2 queue. So when they list that in the breakdown, I suspect if they may be referring to 140s here. Additionally they list either no NIW140 or NIW-based 485s from the NSC. If they are referring to NIW based 485s, this is incorrect, since I am one of those with an approved NIW and pending 485 at the NSC. There are others like me on IV physician forum.
So lets try to get more information about this response. This data does not give the whole story. In a worst case scenario it is indeed pending 140s they have given.

We have just been told by reliable sources that the bill is being sent back to the Senate Judiciary committee where Frist and Specter will rework the language of the bill, starting April 24th.
All reasonable amendments will be worked into the bill text itself. Our amendments have a lot of support and the intent is to include them into the text of the bill.
So we need contributions going forward to get our requirements into the base text, and to protect them in conference with the House.

1. Waiting for labor for almost 4 years.
2. Haven't made to 140.
3. Wife on H4, very frustrating for her.

I am tired but I would like to do something while I am waiting... that's why I am thinking of starting PMP. That way, if I eventually get GC or end up moving to some other country I will have some value addition.

Couldn't agree more. The problem lies here in the US..Just pure politics...The cost of education is just too high for an american to get a degree whereas a foreign born is able to get it for cheap. Politicians know it and they want to keep it that way. America will just do fine with or without you.

For me as i did similar analysis during CIR 2007 the text of the bill looks very much similar. They had the same issues on H1/L1 except now fraud prevention... Not sure where it goes... Any idea Pappu, PPL seem to be still interested in debating H1Vs L1 etc... For sure more offshoring...

I went through the text of the new bill vis-a-vis current INA and compared the old and the proposed act. Here are the findings -
Section 101 - This spells disaster for all H1Bs in consulting companies (as FT or C2C) -
by striking clause (ii) of sub-paragraph (E) of the section 212(n)(1), and then adding the new clauses under (F), they are PROHIBITING placement of H1B employees on another employer's site, period. This will affect NOT ONLY pure staffing (desi or non-desi) companies who place their W-2 H1B employees at client site, BUT ALSO big consulting companies like IBM/ACCENTURE/DELOITTE et al. No placement/leasing/outsourcing/contracting for services or otherwise at another employer, period - UNLESS a waiver is obtained, which will mean every company will need to obtain a waiver in order to do so, EFFECTIVELY ENDING ANY CONSULTING BY H1B.
Section 102 - This spells disaster for all companies who's H1B+L1 > 50% total employees
by inserting two new clauses (H) and (I) in section 212(n)(1), it prohibits H1B only or H1B preferred advertisements and prevents any company that employees more than 50 employees to submit NEW H1B/L1 application IF the total number of H1B and L1 employees exceeds 50% of its total employees. Now I understand. This guy PBECiskillingme bought a substituted labor (used illegal means) to get his application to move ahead. He thinks everyone is like him and thus criticized IV on our forums. It is because of people like him and employers that sell LC, we all get a bad name. He should also be reported to DOL and USCIS.Very strange and insulting conclusions. The only thing I was telling is that there is still time to get labor substitution done. Also there is a risk. Till substitution is banned it's not illegal.

Chanakya, whatever your arguments may be but calling the current state of EB2-I a "plight" is a little crazy. We are seeing one of the biggest advancements in PD dates for EB2-I. I can understand if an EB3-I feels outraged after reading your post.

Not a bit. If you want I can give you a plenty... L1 is for intercompany transfer. But So far I have seen companies put people only at the client place and their salary is starting at 32K and they are put up at extended staty, asked to share the cab or car. So let me know if you want and I can directly let you talk to those guys.

So our common goal is to fix the broken system, remove the employer's undue advantage over the employee. No matter if they are MNC or desi consulting companies. Why the employee is tied to the employer when there is the need/demand for the skill set. Thats the only thing which is driving down the wages.
I fully agree with this. L1's being placed at Client's place is ILLEGAL. I have several proof's of this. TCS, Infy, CTS and LT do FAVOR their employees with a gift of filing in EB1 because these guys WOULD not complain to any one what they are paid and their benefits.

Based on this poll, anybody with PD of Jun2002 onwards should consider Porting to EB2.

With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.
Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,

If I were in your place, I would not spend money to hire my own attorney- not yet. I would let the insurance attorney handle the initial few months, and only after things start happening, I'd think about paying an attorney myself. Meanwhile, use this interim period to look for a very good attorney- meet with a couple of them and decide which one would you choose, if you had to. Personal liability defense is handled best by firms specialized in tort defense (eg. who defend medical malpractise suits), and NOT by trial lawyers who are mostly experienced with plaintiff's cases.
Another thing, since YOU were the one who seems to have experienced most injuries in the accident, didn't you get letters from trial lawyers offering to sue the other folks and ask for damages (since THEY were at least 20% responsible for your injuries)? Such trial lawyers do not take any money from you upfront- they only take a % of the money recovered. This might make things too messy for you to handle- but give it a thought; sometimes offense is the best defence.
I agree.. you should be suing the other party in front of you for injuries since they were the ones who stopped and as the person said - offense is the best defense .
If I remember correctly the first car in front of you had already collided with the car number 2 and hence all the accidents. I don't know how they can put you at fault . So let the lawyers handle it and go all the way .

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.
