Well per=country limit is part of the iNS law. So its legal.
From an immigration perspective, green card is a privelege extended to "aliens" and it is the prerogative of the law to ensure a formula thats best for the country.
INS family based immigration law was the one that conjured up the per-country limit to prevent folks from one country from flooding in. Unfortunately, this formula made its way into EB immigration and we are stuck with the consequences today.
So if anything, we should bring up the fallacies in per-country limit as far as skill-based immigration is concerned and get the law changed.

I received "Notice mailed welcoming the new permanent resident" email this evening(Sunday). The only emotion i feel right now, after being in this country for 9 years now, is relief.
i have an EB2 140 with by current company with jan 2006 priority date.
i tried to port priority date of my EB3 140 with my old company (Sep 2003) and that worked out finally.
initially i sent the letter to port date in march 2009.
I resent the letter to TSC last august. I noticed a LUD on my case after this letter on both 140s.

Yes, there are sub-limits in ICICI for persons above the age of 55 years. Please look at the policy wording, a 16 page document. Look at Page 3 in a section called 'Special Conditions'. It is mentioned there.

Am I the only one who thinks like this.. correct me folks.
The guy who initiated this conversation came here nearly more than 3 months back, has just 5 posts but a ton of energy to fight with US employers. Starts a topic, and we are all getting diverted in posting in this thread.
I definitely support complaining against anyone who breaks the lawy, be it employer, or employee.
In this case the guys as he "claims" appears to have come here without employer calling him. And is trying to complain against. Who will be screwed up. The employer can easily say he anticipated, but no project no, so didnt get the guy to US, as its legally allowed not to get.
Again, I STRONGLY feel this thread, and the similar, are all in an effort to divert our attention. Just stop these by not bumping them, with our comments. Let mine be the last.

I think we as high skilled immigration community need to accept some sort of restrictions on H-1B visa for our provisions for lost visa recapture or additional EB permanent visas. We need to let Senator Grassley know what we can accept. Otherwise everybody is at standstill and nothing will happen.

If you are not in india, then you are somewhere to earn more than you do than in india. So investment is safe if you can afford to invest in that property without a loan. If you are taking a loan you are getting ripped off. STOP there.
to me agricultural land is next to investment in gold. agri land always holds value(sale value) or appreciates over time. Always you can get decent return by farming something there. So my belief is you always get 6%+ return on investment over short/long period of time.
city properties are just a ripp off. So get only one property if you want to live for yourself.. Investment of say 50 lacs on a flat(condo), may give you a good rent. But for how long? and what % of interest you pay on that loan? And what will the aging affect be on that flat!!...

If 20,000 people donate 5$/ month = 1.2 million $/ year.
= 1 million $ (after loosing transaction charges)
So next step enable 5$/ month to 100$/ month RECURRING contribution arrangements ASAP.
To avoid transaction charges let users pay quarterly or half-yearly recurring.
i.e. if one wants to donate 5$/ month so it will be 30$/ 6 months etc.

All great Ideas and we are never short of Ideas on this website. However, we are always short of commited people who are willing to put in time and make their Ideas become a reality. We sure are 25,000 real members and If each of us commit 10$ every month diligently we have a consistent cash flow of $250,000 every month and committing 10$ every month is not hard at all. All of us in here are highly skilled, we all have decent paying jobs and we are definately not cheap labor because we have US Department of Labor (DOL) certifying our salary before we take up any Job in this great land.
Would you be willing to the lead on making your Ideas become a reality. We have very few highly committed members in here who can provide support and guidance.

The hardships we have chosen to enter united states and struggle here is of our own choice. It was an option. You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
We all have options and it depends what you choose.

I am wondering the same for 2002 applicants. I wonder if many people were approved in 2007 fiasco and if yes, then why PD is stuck at Nov 2001?

The reasons for Nov 2001 PD could be due to backlog processing centers that held sway over these applicants (non-RIR cases), but by same yardstick, there still should be some cases in early 2002. Odd indeed (though a good kind of "odd", as we will get a welcome jump in dates once they ball starts rolling).

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.
So there, you have your update? If you want to know more, then call us on the phone.
And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.
If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.

If you are one of those members that were once part of IV and either got banned or left because you felt we are working against your interests, then you were never part of this community and effort. This is a genuine effort and a lot of people's careers and personal lives are affected due to the greencard problem and we are genuinely trying to fix it. If you are trying to spread a negative message urging people not to contribute and posting negative remarks, then you either are not affected by retrogression (and so you dont belong here) or you are so naive that you are hurting your own interests by posting negative remarks on other forums.
Lets also see how many members are willing to come forward to actively work for IV and also contrbute for the cause.
lets also see how many H4s come forward to volunteer their time for this effort. We are on H1s and find it hard to manage our jobs and IV work. H4s can be a great asset in our volunteer efforts on various fronts.
lets see if there are any H4s who can commit to meeting each and every lawmaker in their state. Lets also see if there is any H4 in DC area who can commit to spend some hours daily meeting staffers in various DC offices and doing the running around work that some core members do by travelling to DC on their own money and use up their entire vacation time.

I agree with the initial post . But the market condition is such that it is very difficult to get qualified people for ERP/CRM applications so desi consultants get placed through desi companies .

No one know what goes in the consulate office but what you can do is call the local vfs office and tell them what happend and ask them to see if the consulate has handed out ur PP to the couriour company. They might have some information for you.
