I have started a new thread to remind everyone (who has not yet contributed) to contribute for the just concluded Advocacy day.
Take some funds from any money that you put aside this year for charitable causes or temple donations. All that you contribute is money well spent - as eventually it would benefit a number of people and entire families. So helping people better their lives is like contributing to charitable causes. Even $50 is good to start with. Hope that motivates all.

Consult a good lawyer, prepare an appropriate reply based on true situation. If they feel that the request is genuine, they will approve else be prepared for the worst.
To be frank, i don't think any company like the one you explained even exists! I will be surprised if it does, and if it does I won't wonder if there is no RFE in the current enforcement days from USCIS.

You can take time off -- like 4 weeks without any issue (I have done this), as long as the new company has filed to transfer your H1B petition.
I guess you should avoid going out of status -- where the old company has revoked your H1B when the new company hasn't even filed the H1B transfer petition. Other than this, taking time off between jobs should not be any problem at all, provided you stay within the country and, no travel outside the US. But if you do, you should consult your lawyer about its implications. Good luck with your new endeavors.

Hello, I am an INdian citizen currently workin in the US on an H1-B visa. I need to travel to Europe for leisure in the month of April. I wanted to go to the Bern Consulate to go and get the stamping done for my H1-B renewal on my passport. I wanted to ask if anyone has gone to Bern to get their H1-B stamped and can share their experience?
Also, do you recommend that I go to Canada or Mexico instead? I have heard ppl saying that you should go to your home country or Mexico/CAnada. ANy experiences that you can share with the Canadaian/Mexican US consulates would be appreciated as well.

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

I was in similar situation during 2006. I applied for H1 1 year extension based on PERM approval. My LC was just 1 month old . Then premium processed my I-140, once I had my I-140, I then premium processed my H1 extension based on approved I-140. Finally got 3 year extension.

Hi. I just e-filed my I-539, status of change request from F-1 to H-4. I just found out that I chose "North Korea" for my citizenship, while it was supposed to be "South Korea". I chose "South Korea" for the passport issuance country.
How can I fix this? Should I attach a letter explaining this, when sending the supporting documents? What else supporting documents should I submit, other than my husband(H-1)'s paystub, I-129 approval notice and our marriage certificate?

you need to write a covering letter describing your mistake and mention all the supporting documents
Supporting documents can be
1. your passport
2. your husband passport with your name mentioned on it
3. your birth certificate
4. your educational certificate (if it specifies your country of birth)
I would suggest to send at least two or three supporting documents which shows your date of birth.
In fact I did the same problem and I had to send the supporting documents.

I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

I am having the same issue.Applied AP online on 1/10/11.Got receipt no and Application as PDF.I have the Receipt no and sent all supporting document with LINXXXXXXXX no.But I have been trying to add the case no to my profile and it says not found.I am not sure what can I do or wait for more days.

Its hard to say what is SAME OR SIMILAR. I am stuck up with the same issue. My GC was filed for the position of Software Engineer and I changed the job with same responsibilities but job title is Project Manager. My attorney is not comfortable with that even though the responsibiities are same in the new job.
Its better not take this AC21 path unless you are 100% sure that your new job is same as the old job.

Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.
On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer.
