Yes it is good that they are changing the rules despite opposition from lawyer association. Lets also hope that it gets implemented soon since there will be some opposition until it comes into effect. A lot has been changing in these agencies. Decoupling of H1 and H4 time, now Labor sustitution, premium processing, classification of service centers Etc. (we dont have a long list yet!) All this is also due to the phone calls people have made, letters people have written, articles media has published about inefficiencies and broken system, lawmakers people have met and aired their problems. Lets hope the wheels of change start moving fast enough for us.

ok, I did not take private coaching (not that its relevant to a 3/4 year degree) and we had quite a few lower-middle class students in engineering.
As for poor families - A MCA at IGNOU costs a little over $1000. I'm sure its similar in other distant learning courses too.
that may be the case...but maybe the guy couldn't afford the 4 year engg...did the way way cheaper 3 yr bachelors...then worked ...made some dough...decided to study further to advance...so did MCA ( repeating a 4 yr bachelors is not sensible or economical at this point)
This is all speculation ofcourse...the point is we don't fully know the person's circumstances and should not judge based on face value of the degree...if the person is talented he/she will be retained by companies who want to keep them.

lots of EB3 qualify for EB-2 after such a long wait and in the first case they were put into eb3 although they could have gone to eb2...
I cant believe that EB-3 is at 2001 when we are getting to 2009..its really a shame on the system
if this is how they treat people the entire h1b needs to be scrapped or people spend thier decades in slavery working this unpredictable system thinking that they will get in next few months..its like chasing a mirage in the desert....

Growing up I use to goto an organization wearing kakhi-chaddi, so I grow up hating Mahtma Gandhi (but that ws long time ago),
I now has so much respect for this Man, I wonder how was he able to cheer and integrate my fellow Desi's ;) almost 60-80 years ago, if I think about it now seems almost like a miracle.
We really need to look into his life and find some answeres, as we have long battle and it is just getting started

Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.
Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.
With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.
With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!
Your theory that land values never fall in india is not true. Here is the proof. It is a question of affordability. Even if the population explodes and since most of them are poor, there is no justification for such high price appreciation we had in the last 5 years.

I wanted to add a few points again - after reading the previous posts from Alien2006 and Chanduv23.
To alien2006' posts I want to add the following:
Funny how many of us have noticed the flow of suggestive ideas that we are given right from the time we start the H1 process - back in our home country:
1. Prospective H1 employer suggests the following (nothing in writing of course):
"Great. You are very smart and deserving. We have choosen you to be one of the lucky few whom we will take to America this year after filing your H1-B visa. Once you land there on the H1-B visa, everything will be great. You will have a job in a few days with one of our clients (Buzzer - this is one heck of a lie - there are no confirmed jobs - one has to go through the whole process of interviews again to find a project where you will be accepted on a contract position. Rarely I have seen H1 companies who have projects of their own for their employees...but no one tells us that!!!). After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. You will be all set with the wonderful American Dream in less than 6 years which is the validity of your H1 visa!!!. (Buzzer - One more great turd of BS - Yes they will apply our green card...BUT they may or may not pay for it...they will apply but there are 195,000 H1s and only 7000 Green cards per year for India - guess what MOST OF us will only dream of a green card and may never get one).
Folks here shout at us about why we "expect" to get a green card when we "know" that we are here on a temporary H1 visa - WRONG - we know that H1 is temp - but we also are made to think that H1 is the first natural step towards a green card. Also - if we are "temps" no one - employers, for that matter - any organisation that we come accros in our "immigrant lives" here in the US try to highlight that YOU Are TEMPS...WE JUST GOT YOU HERE TO BE A TEMP WORKED, EXPLOIT YOU IN WHATEVER WAY WE CAN, MAKE A QUICK BUCK ON YOU...and then put you on the sinking broken boat called "GC process" and forget about you!!!. No wonder we think we think that we deserve to a fair and simple GC process - but it should be made simple and fair - coz thats the sublimal message we have been dumped with for the past 6 or 7 years...its now time for them to come through on their promises.
To Chanduv23 post - Yes I agree things are much better now...in the last 10 or 15 years....and probably thats the reason more people want to come here and work here...I know I love my job, the people here and the whole way of life here.

If IV is shutting door of any questions you wouldnt have seen forum threads. There is enough discussion and direction taken on information being released to ALL members. Why one should complain IV not doing anything ?

Reason one has donor forum is becoz they are trusted sources. How can one know that you are pro-immigrant or anti-immigrant.
You would see dialy or minutes updates on sites of anti-immigrants becoz they have dedicated members and number base is too high.

On the other hand we get newsletters from admin that ask up to tighten our belts etc. - and get more involved. Well, that cannot happen unless IV provides more updated information on what IV is actually doing, veiled references to behind the scenes activity and years of hard work are not enough to involve all those who have signed up here to become 'more involved'.
As for this discussion going nowhere I could not agree more - you see to have an open discussion or indeed debate - there must be at least 2 willing participants. And since you have already decided that you do not have time for the Qs of a mere non-paying member of this forum, I do not expect any better.
By the way, the way ahead is not to close doors, but to welcome questions and encourge those on this forum with curiosity to be more active. 1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.
2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.
3) USCIS should be fair to India. If you look closely, USCIS rules are not country specific. Quota applies to every country, but only India, Mexico and china exhaust theirs. Does tell u something doesn't it.

Was the Department of State's unprecedented action on July 2, 2007, issuing an "Update on July Visa Availability" closing off visa availability for the rest of the fiscal year for employment based cases and essentially gutting its July visa bulletin (which opened the employment based categories EB-1 through EB-3 for adjustment of status applications) all about the money with U.S.C.I.S. in the role of culprit? We believe the answer unfortunately is "yes" and reflects U.S.C.I.S.'s desperate desire to grab its huge future fee increase from individuals that it saw slipping through its fingers. U.S.C.I.S. undoubtedly perceived its expected windfall of hundreds of millions of dollars through its outlandish July 30th increase in fees for petitions and applications (average increase 66%) threatened by the July visa chart which would allow many employment based individuals and their families to beat the fee increases. A typical family of four (husband, wife, child aged 16 and the other 12) applying for adjustment of status currently pays $1,605 to U.S.C.I.S. (including I-140 charge). U.S.C.I.S. has made no bones that it is depending upon the fee increases to fund its proposed systems and structures for the 21st century.
The Visa Office made it clear through the updating of the visa bulletin that its update was only because of U.S.C.I.S. action using the phrases "The sudden backlog reduction efforts by Citizenship and Immigration Services Offices during the past month....", and "As a result of this unexpected action....." The Visa Office cited these efforts as resulting in the use of almost 60,000 employment numbers. It is also clear that the Visa Office had no wish to defend U.S.C.I.S. when it issued its update on July 2nd. Whether it retains its stance in the future of washing its hands and pointing the finger at U.S.C.I.S. remains to be seen in light of probable Administration pressure to spin the story in a more positive light to the government as this Administration has exhibited a continual attitude of "soaking" immigrants, legal or otherwise ( $25,000+ for a family of four to immigrate under the recent fallen Senate bill ( See our article, "$10,000 Required For Earned Legalization and Adjustment Under the Secure Borders, Employment Opportunity and Immigration Reform Act", http://www.alanleelaw.com/english/articles/a2007-05-26.htm), which figure was modified from the earlier Administration proposal of $82,000+ ( See our article, "Mr. Lee's Comment to March 28, 2007 White House Immigration Reform Proposal - Z Visas", http://www.ilw.com/immigdaily/digest/2007,0403.shtm in "LETTERS" section), the passed amendment to S. 1639 raising H-1B surcharge fees to $5,000 on top of the fraud ($500) and filing ($190) fees, and the rapacious July 30th U.S.C.I.S. fee increase). The author recalls his telephone conversation with Charlie Oppenheim, the chief of immigrant visa control and reporting, Visa Office, in December 2004 concerning the 101,000 "pool numbers", in which Mr. Oppenheim gave no credence to U.S.C.I.S. figures that the agency had cleared over 100,000 cases (including dependents) between April and November. (The exact differential was 115,000 cases, a rate of about 16,400 per month). The author has no knowledge of the exact number of cases that U.S.C.I.S. claimed to close in June for the State Department to announce that almost 60,000 employment numbers were used (employment based immigrant visa numbers are also requested by U.S. consulates and embassies), but notes that the vast majority of employment based cases are with aliens in the States who adjust status here rather than consular processing their cases. If U.S.C.I.S. claimed to clear anywhere in the area of 40,000-50,000 cases last month, that number for one month is difficult if not incredulous to believe, and if true would have involved massive shifts of U.S.C.I.S. personnel from other responsibilities to comb through and adjudicate all files of persons eligible to immigrate through employment, or less than careful consideration of the cases. Hopefully the agency was not in such a desperate state as to cut corners to endanger our national security if it was the latter case.
The facts and the legality of U.S.C.I.S.'s actions will undoubtedly be the subject of multiple lawsuits. However this turns out, the agency and the Administration will wind up with less respect than before. This Administration needs all the good publicity that it can muster in light of its unpopular Iraq war and recent actions freeing Scooter Libby (not even Paris Hilton avoided imprisonment) and supporting Attorney General Alberto Gonzales and creating further public mistrust of the justice system even after confirmation that he and other White House aides politicized the selection of United States Attorneys. Unless U.S.C.I.S. and the Visa Office can change course, this episode will unfortunately become a black eye to all parties as further facts emerge in the coming days.

Was the Department of State's unprecedented action on July 2, 2007, issuing an "Update on July Visa Availability" closing off visa availability for the rest of the fiscal year for employment based cases and essentially gutting its July visa bulletin (which opened the employment based categories EB-1 through EB-3 for adjustment of status applications) all about the money with U.S.C.I.S. in the role of culprit? We believe the answer unfortunately is "yes" and reflects U.S.C.I.S.'s desperate desire to grab its huge future fee increase from individuals that it saw slipping through its fingers. U.S.C.I.S. undoubtedly perceived its expected windfall of hundreds of millions of dollars through its outlandish July 30th increase in fees for petitions and applications (average increase 66%) threatened by the July visa chart which would allow many employment based individuals and their families to beat the fee increases. A typical family of four (husband, wife, child aged 16 and the other 12) applying for adjustment of status currently pays $1,605 to U.S.C.I.S. (including I-140 charge).
