Thats what my question is. I think they just replied to cough up $5K from us.
This is just delaying techniques by USCIS. I think they are assuming that no one is going to pay this much amount and they can hide the BS they are doing!

Wanted to find out about the visa options for my wife�she will be coming to the US on an H4 visa�can a company hire her on an L1 or any other kind of visa or does she have to wait for an H1B until the next year quota opens up�She has an MBA Finance degree from Mumbai university & currently working with a multinational bank as a credit analyst�Kindly Respond.

Here is a letter I drafted that I'd like to send to the Ombudsman .. could you'll help me edit/revise the content and also, please provide me with the contact info for the ombudsman?
we could also write letters to highlight this to Congresswoman Lofgren as well as publish it in media outlets?

writing to highlight the ongoing egregious inefficiencies in the immigration �services�
provided by the USCIS and the DOS. There have been numerous times when there have been erratic movements in the published visa bulletin dates. As a result the DOS either under- or over-estimates the number of applicants available for adjustment of status. When the date moves forward by too large a window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that???
Indian employment-based immigrants are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:
1) Extended wait times at each step of the immigration process.
2) Lack of transparency on the part of USCIS.
3) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).
While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of this extremely lengthy process. good work Sherman_tribiani, i am watching this group of "highly skilled job stealer� for sometime. they merely talk and do nothing. most of them r scared to do anything. they r scared of u & me. they r not scared when they steal our jobs and we will scare the hell out these ba$tard$ to make them do in their pants before we kick them out. gheen told me about this group and he also said that not to waste my time on these job stealers as they r weak and incapable of doing anything, other than stealing our jobs and outsourcing.

i think v r f'ed up big time; part of the problem was setting our hopes higher.
on another note, if some ppl call this a rumor, I would say this is US and "almost all" rumors in US are true.

Yes it was stopped in 2007. But it still has its shadow. Back in India Did you leave in area where there was shortage of water? All I said is do not call them as jealous. They have valid grievances. If they want they can fight.

With my limited understanding, what I realized in last 2 years is this: VISA RECAPTURE and RETROGRESSION aka discrimination based on country of birth are the biggest obstacles for those born in countries like India, china, Philippines and Mexico. (Do you want to say that it is okay to be descriminated for being born in one of those countries?) So it does make sense to address these 2 issues. If I have limited energy (read money & support for lobbying, campaign etc), I would spend it towards where it can benefit me most.

As some folks have posted on another thread, the USCIS is finally getting around to consolidating all their applications in a single database.
Maybe our letters and posters didn't fall on deaf ears after all! ;)
I hope so, we just have to wait to see when that will come into effect, perm took more than a couple of years to come into effect and what happened after??.. all the pending applications at that time was pushed to the BEC black hole...

If you read the first post, the senator (I think it was Kennedy) made a big deal about some immigrant he knew who had a very 'ordinary' life. All of us in IV are atleast one step ahead in the sense that we all are 'highly skilled'.
It could be about a Software Engineer who cannot get a promotion and has to reject more lucrative/satisfying offers from other firms to a person who is qualified as a High School teacher who cannot teach because she does not have an H1 visa
It could be about someone getting frustrated and applying to Canada as a backup otion or someone. Someone else might have a spouse who has been on H4 for 6 years and now cannot work inspite of avaiability of sponsor because one may use only 6 years of H visa.
Guys, unless we all chip in, lets forget about getting any resolution to this issue. IV is doing all it can and has been getting some success in getting amendments introduced. But unless we all step up to the plate, we can assure you it will be very difficult for us to protect these amendments in the senate. House conference will just chew us until we make some noise.
There are 3000 members on this forum, can't we even get a 100 decent stories to pass on to the media? Its difficult to convice media to write about us with only 5 people's stories......please chip in....as promised, no personal info about you will be revealed, unless you explicity mention that to us....

Thanks for your support. I usually don't respond to trolls. It's just best to ignore them. I think that in life in general, it's best not to get angry or harbor hate against anyone. It's self-destructive in the long run.
