Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-)
Don't know its good or bad. Any idea anyone?
Is anyone else in a similar situation?

Unless you know the outcome, you never know.
Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.

Two questions for the experts...
I am on J1 visa and have received a home residency requirement waiver. Do the experts here know if I can apply for a J1 visa extension (after receiving the waiver)? I read somewhere that it may not be possible to do so.
Also, are there are any foreign travel restriction on a J-1 visa?

Hi, I have a question.
1. My colleague crossed 2 years after filing 485. Frustrated with GC processes, he is switching company for better career prospects. He is using his EAD and invoking AC21. Is it possible for me to use his labor? If no, why?

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.

- Was the I-134 part of your I-485 application, or was it part of your dependent's?
I am asking this because there is no instruction regarding such an affidavit in the Initial evidence section of the I-485.

Hi I am on H4,
Yesterday my h1b was approved ( cap h1b)
I got an offer from another company , ready to file my h1b ( non -cap) asap.
My question-If i apply for h1b transfer to non-cap without working for cap company in 7-10 days and later If I want to join a cap company,will I have to go through the lottery again -basically will i be subject to cap.
2.what is the proper process for transfer to occur.
3. I do not want to inform cap company.I have the receipt number.Is it sufficient to apply for transfer.

U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.
The fiscal year cap (numerical limitation on H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)) for FY 2011 is 65,000. Additionally, the first 20,000 H-1B petitions filed on behalf of individuals who have earned a U.S. master�s degree or higher are exempt from the H-1B cap.
USCIS will monitor the number of petitions received and will notify the public of the date on which USCIS received the necessary number of petitions to meet the H-1B cap. If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date. Before starting the application process for permanent immigration, foreign nationals who enter the United States on non-immigrant visas (NIV) are considered to be here temporarily. The law presumes NIV holders intend to return to their home countries at the end of their stay in the United States. There are many NIV categories — student visas, business visas, visas for tourism, and investor treaty visas to name a few. Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

I understand that after getting your 45day letter your case will be in the BEC database and will be processed in order.
Now I just saw people on this forum with PD Aug 2003 got approved 10/17.
and I know a friend with pd oct 2003 got approved in April.
Suppose that the guy got approved 10/17 was input to the system after the other luckier guy, the most conservative estimation is now pd Aug 2003 is being processed.
Anybody heard of any later PD being approved recently? from DBEC?
I'm just thinking, if we share the pd/approval information on this forum we'll have better estimates about our cases and have a somewhat less stressful life.
