I have one more question, please advise.

now what if I apply for F1 visa and it get approve say 2 months before her actual class start date. as soon her F1 will get approve she will be on F1 status , so is there any problem she stay on F1 for some period before her actual class start.

for example her actual class will start from 1st of August 2011 and we apply for her F1 on 1st may and it get approve by 15th May and from the approval date of F1 (15th May) she will be on F1 status. but as said actual class will start from 1st Aug 2011, so is there any problem or illegal if she stay on F1 from 15th May 2011 TO 31st July 2011 (75 days) on F1 without her actual class starts ?

My wife already have H4 extension which is valid until 2013.

Take infopass, go with your welcome notice, get 551 stamp - it will allow you to travel until you get the physical card. Usually, 551 stamp is valid 1 year from the date of stamping.

I know some people who have traveled using 551 stamp in the past. They had to go through secondary inspection, carried all their docs with them, but everything went fine.

140 APPROVED.

In addition to the first RFE as above,i received one more RFE.In the second RFE they mentioned that education and experience satisfies labour,but wanted more documents from company to prove A2P.Company sent tax returns and got the approval in 6 days.Yet to receive the notice.

If they do implement a new F4 visa, they will allow you to transfer to F4 status I believe. And then current PhDs would be getting the benefit of the new law. Its unlikely that biological science are not a part of physical sciences. What they mean when they say "Physical" sciences is that other sciences like Tom Cruise's scientology and stuff like astrology/palmistry and other fake science is not included as a field in which one could do PhD and obtain GC.

Watch what you say! We might have Tom Cruise jumping on Oprah's couch cursing ImmigrationVoice for a post like this ;-)

Which US consulate did you apply? Do you already have H1B on your passport? I think the best option will be to approach your employer and have them sort this issue out. Sometimes, the consulate will request for some additional information from the employer and once they get this information, they will issue the visa.

I too think requesting the employer to take the action, with their lawyer. If they are good, and with no issues, they must initiate this and fix it,
but if they are not good, they may withdraw at this point and may feel "lets not get into more headaches"... in which case you may not pursue further.
I can imagine how it feels, belv me, yet, keep looking and dont give up

My I-485 was filed on Dec 1, 2006. I called USCIS and had info pass and they told me that my name check is not clear. I talked to one lawyer and he is going to charge me 3500 for WOM. He has pretty good success rate. I am reading forum where they say it is better to wait minimum 2 years. Has anyone heared any case where wom is filed after one year and it was successful. My priority date is current.

I recommend you to wait 6 more months. There are successful cases were the wait was even less than a year, but all of them are pre-NC. After NC was implemented, the average wait for successful cases is 2+ years. Saying that, you can try to file WOM now especially if you live in Northern California. Did you write letters to senators/Bush/Mr. Gonzalez?

Here is what I found on USCIS website for renewal I765

I filled my EAD with I485 on August 2007. I got my EAD on 10/21/2007 which
is expired and want to renew it.

Do I need to pay the filing fee? Here it says any one filed I765 before July 30th 2007, they need to pay the renewal fee but nothing is mentioned for those who filed afterJuly 30th 2007?

Does any one has any idea?
