And, if everybody was promised the current system, then there should never be any change, ever, because whenever you make any change, it will be unfair to the people who are waiting at that time, right? Your company is not a sample of the entire population. The H1B program is not on-demand program. It is once in an year annual event (because of the demand). US based companies when they get a new project which needs a position, if they cannot hire locally, cannot get H1B worker from overseas when they want. So, in anticipatory mode they have to get some numbers and utilize them and we do lose some H1B visas if they cannot bring them for various reasons.
Is it fair, may not be. Is it widespread waste, I don't think so.

It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.

I just checked the USCIS website and found out that the approved H1 which has been reopened has a Last Updated date of 09/30/2007....
09/30/2007 was a Sunday...why is USCIS working on the case on Sunday ???

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

How long it takes to get your passport back, stamped with a H4 visa, from the time you attend interview at the Chennai consulate.
Do they delay even for H4's these days? Want to know the average turn around time to make travel plans.

Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?
First of all, I am not threatening to quit IV.
Secondly, even if I quit, its not going to matter to IV.
IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.
I also enjoy that very same privilege. We are not here for things that we appeal to our 'taste'. This is not a forum discussing 'Borat'. We are here to talk about our interests as they relate to greencard and retrogression.

How true! In fact not only we have to maintain H1B to be able to "bring" spouses but we have to MAINTAIN H1B until the our PD becomes current to be able to maintain spouse's H4 status.

I dont see how genuine consulting firms will be affected by this. Those who employ people on H1B with genuine clients will be OK. Only consulting firms who bring/hire H1b employees without any project will be impacted. In my opinion this will help avoid the benching practice...

You did not miss anything. Those affected are bodyshop people who abuse the system. This memo is really good for those of us who do not support abuse. If these abusers get kicked out at POE and their I140 and I485 are denied, it may make more room for those of us who have not cheated the system. If my application is in Q behind these abusers, then I surely want these guys kicked out.

Thanks to the poster who started this thread! He just beat me. Now, this is what we need to know from IV core. How much money did they collectively spend? We need to pay them back, right now! Now, we know what Aman spent, we would also like to know what other members spent. These are the options I can think of :
1. Make this a paid site for the first 3 months. $10 contribution from 20,000+ members would take us to $200,000 in 1 month. Roughly, calculating that the collective money spent by core and other members is $200,000, we would hit that mark in 1 month. The rest of the $400,000 that would be made in 2 months can be for lobbying efforts as the article mentioned that the goal is to get $250,000 more by the end of this year. Core members : Please do not feel 'guilty' for making this a paid site as it is a Non-profit organization. Every body is benefitting from all the sacrifices you have made.
2. From the fourth month onwards, let people decide upon their own how much they want to contribute. But, please allow me to express this idea. If it is going to be $10, $20 one-time contribution etc., we can convince more people (Friends) to contribute instead of $50 or $100. Any money is good money and we should not say no to smaller amounts.
Let us all unite together in making sure that the core team gets their money back. We don't want to feel guilty all throughout our lives.

It looks like, in many cases, employees are ready to put up with the crap due to some reason or the other but come to IV and complain because they want to vent out their frustration and organizations like IV is the sweet old mom who will hug anyone who needs support and they feel the comfort and warmth under IVs arms.
Where else can they go? Not AILA offcourse, not Compete America, not ALIPAC , nor their lawyers, cannot discuss with friends or coworkers - everyone is looking out for themselves and will not bother about other's issues (unfortunately thats how people are)
So many people come here to see if they find some solace - if IV starts a new initiative to help thewse people out - will they come out of their shadows and utilize the services?

Same here. Applied for AP. Got a soft LUD on my I-485 on Mar 25, 2009, got my AP approved on Mar 26, 2009. Does this mean they checked my 485 application prior approving my AP? or are they pre-adjucating my application? Will wait for a week or 2 to see if i receive any RFEs.
My PD is EB-3 I, Mar 2004 and no way closer to being current.
I got an LUD on 485 when i got AP approved.

We are languishing close to 85K. It is very important that we reach 150K very soon. There are some big decisions pending because of that.
Does anyone know how close are we in achieving this target, did we atleast cross 100k?

IMO, this is the biggest problem plaguing IV - perception of IV as just another online forum (community) or a "chat room" as a newspaper reporter put it ! (http://www.freep.com/apps/pbcs.dll/article?AID=/20071123/NEWS07/711230422/1009) (under the heading "Taking Action").
This point IV = chat room has come to the fore, several times in discussions. A lot of persons have refused to join IV efforts with the ruse "IV is just an online forum where members discuss mundane matters". Whether someone admits it or not, IV has a serious image problem !. It needs to be corrected soon (by more than making another announcement type "We are not a forum" post !)
Strength of an(y) organization comes from contributing, active members. And not from MINOWs (Members-In-Name-Only Wusses)
